1. Definitions
“Client” means the individual(s) or company at whose request or on whose behalf the Surveyor/Consultant undertakes marine surveying or consultancy services.
“Disbursements” means the cost of all reasonable photography, reproduction of drawings, diagrams, sketches, printing, duplication, and where applicable, electronic transmission fees, as well as reasonable expenses including travel and accommodation where an overnight stay is necessary.
“Facility” means the port, marina, or similar location where the Vessel or object is located.
“Fees” means the fees charged by the Surveyor/Consultant to the Client, including applicable taxes and any Disbursements.
“Report” means any report or statement supplied by the Surveyor/Consultant in connection with instructions received from the Client.
“Surveyor/Consultant” means Mickdi Pty Ltd trading as Maritime Projects, providing marine surveying and consultancy services under these conditions.
“Vessel” means the object of the survey to be reported on.
2. Scope
The Surveyor/Consultant shall provide services solely in accordance with these Terms and Conditions.
3. Services
The Client shall set out in writing the services required. The Surveyor/Consultant will confirm acceptance of those instructions in writing or verbally, or alternatively specify the services to be performed.
Once agreed, any changes or additions must be confirmed in writing by both parties.
For the avoidance of doubt, where instructions are not provided in writing but are accepted by the Surveyor/Consultant, the services will still be provided in accordance with these Terms and Conditions.
4. Payment Terms
The Client shall pay all invoices in full prior to the release of any reports or deliverables.
Invoices not paid within 30 days of issue will accrue interest at a rate of 8% per annum above the base lending rate of the Bank of Queensland, calculated from the due date.

Payment may also be made via credit card, subject to processing fees charged by PayPal.
Any costs incurred in recovering unpaid invoices will be payable by the Client.
5. Obligations and Responsibilities
a) Client Instructions and Access
The Client must provide complete written instructions in sufficient time and ensure safe and adequate access to all relevant sites, vessels, and facilities.
The Surveyor/Consultant is not liable for issues arising from incomplete instructions, delays, unsafe conditions, or inaccurate information.
b) Surveyor/Consultant Duties
The Surveyor/Consultant shall exercise reasonable care, skill, and diligence in accordance with accepted marine surveying practices.
c) Reporting
A final written Report will be provided unless otherwise agreed. The Report will outline findings relevant to the scope of work.
d) Confidentiality
Confidential information will not be disclosed to third parties without consent, unless required by law. The Client must clearly identify confidential information in writing.
e) Intellectual Property
All original work remains the property of the Surveyor/Consultant unless otherwise agreed.
f) Conflict of Interest
The Surveyor/Consultant will notify the Client of any conflict of interest or limitation in capability. Fees remain payable up to the date of notification.
6. Liability
a) The Surveyor/Consultant is not liable for any loss, damage, delay, or expense unless caused solely by proven negligence.
b) Where liability is established, it is limited to the lesser of:
Ten (10) times the Surveyor/Consultant’s fees; or
AUD $100,000
c) These Terms are subject to the Australian Consumer Law. Where applicable, liability is limited to:
Re-supply of services; or
Payment for re-supply of services
d) The Surveyor/Consultant is not liable for damage to vessels, facilities, equipment, or third parties provided for inspection.
e) Market Valuation
Any valuation is valid only at the time of inspection. The Surveyor/Consultant is not responsible for future market changes.
f) Regulatory Delays
No liability is accepted for delays or changes caused by regulatory authorities, including but not limited to:
AMSA
Maritime New Zealand
Classification societies or flag state authorities
7. Indemnity
Except where liability is established under Clause 6, the Client indemnifies the Surveyor/Consultant against all claims, losses, damages, and expenses arising from the services provided.
8. Force Majeure
Neither party is liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, strikes, or government actions.
9. Insurance
The Surveyor/Consultant maintains Professional Indemnity and Public Liability Insurance.
If additional insurance is required by a Facility, the cost may be passed to the Client.
10. Subcontracting
The Surveyor/Consultant may subcontract services but remains fully responsible for their performance.
11. Time Bar
All claims must be made within 12 months of the final report date, after which liability is extinguished.
12. Travel
Where travel exceeds six (6) hours total flight time, fares will be based on:
Premium Economy (minimum), or
Business Class where Premium Economy is unavailable
The Surveyor is expected to commence work promptly upon arrival.
13. Jurisdiction and Law
These Terms are governed by the laws of Queensland, Australia. All disputes fall under the exclusive jurisdiction of Queensland courts.
14. Amendments
These Terms and Conditions may be updated at any time without prior notice.
